Terms of service

Payment

Payment for non credit account holders and all export orders must be made by cleared payment before despatch. Payment options include PayPal™ and all major credit and debit cards. The seller reserves the right to decline certain types of payment without reason. The seller may also request payment before certain goods are ordered in. All valid TacTree product codes and quantities will be accepted as having been checked.

VAT (Value Added Tax)

All prices in the price list and internet site are displayed including VAT as standard. VAT will be charged at the current UK VAT rate for all products, services and carriage charges except where specified.Customers claiming to be exempt from VAT under the zero-rated schedule must always submit a VAT Exemption Certificate along with a written order otherwise VAT will be charged and cannot be refunded. Persons disabled or chronically sick may be eligible for relief against VAT on certain products, relating to domestic & personal use only, with reference to VAT Notice 701/7. If you believe this is the case please ask for details at the time of order. Please note that not all products are eligible for zero rating.

Title of Goods

Risk in the Goods shall pass on to the Buyer on delivery for UK customers and on dispatch for all export orders. Title in the Goods shall not pass to the Buyer until final payment has been made. All Goods remain the property of TacTree until payment is received in full.

Delivery of Goods

Delivery dates given by the seller are approximate only and do not form part of the contract. The seller accepts no liability if delivery dates are not met. The seller reserves the right to amend its prices without prior notice.TacTree reserves the right to update its published prices. The Buyer has the responsibility to check product pricing and any discounts or special prices at the time of ordering. Any requests for bulk pricing, export or tenders will be made on an ex-works basis only.Carriage is not quoted in the price list and will be charged at the current rate on all orders. The seller will endeavour to use the most cost-effective means of delivery but makes no guarantees regarding delivery.Restrictions on the sale of certain goods apply and the seller reserves the right to refuse orders where restrictions apply. The buyer is requested to co-operate fully when certain checks are required by Company Policy, and various national regulations.When signing for the goods the customer should always ensure that the external packaging is not damaged or appears to have been tampered with if so this should be noted on the carrier's delivery sheet. The signature “UNEXAMINED” is regarded by the carrier's as equivalent to a clear signature. A verbal notice of shortage is unacceptable.

Returns

Goods cannot be returned without the prior permission of TacTree and the issue of a valid returns authorisation number which must be clearly marked on the outer carton packaging (not the product packaging).Goods must be returned complete with the manufacturers packaging and instructions in an un-damaged and re-saleable condition. When trying on items of clothing, please ensure that you are not wearing perfume / aftershave or a deodorant which may leave a scent or marks on the item. When trying on footwear, please ensure that you try them on a carpeted surface where no marks can be made to the sole. We will be unable to accept the return of any item where there is evidence that these instructions have not been followed. The item must be returned in its original packaging with any enclosed documentation and any original tags attached.Goods not returned in accordance with the Terms and Conditions may (at the discretion of TacTree) either not be accepted or attract a re-stocking and administration charge (whether or not a credit is due) of:i) Within 4 weeks of delivery - 15% handling chargeii) Within 1 - 3 months of delivery - 25% handling Chargeiii) Agreed returns will be subject to a minimum charge of £15iv) Special order, non-stock items and/or exceptional quantities are NOT eligible for return unless explicitly agreed, by the company in writing beforehand.The issue of a return authorisation number does not constitute acceptance by the seller that a credit will be made. The risk in returned goods will not pass to TacTree until a credit is made.Any alleged defects or delivery shortages must be notified, in writing by the Buyer to TacTree within 3 days of delivery. Complaints in respect of alleged defects will not be grounds for the Buyer to withhold payments and give no right of set-off against payment due from the Buyer to TacTree.Credit will not be issued for returned Goods, which, in the opinion of TacTree, are in an unsaleable condition. Returning goods to the seller is the responsibility of the buyer. If the goods are returned because of a fault by TacTree or a valid product defect as stated in these Terms and Conditions, TacTree may at its discretion refund reasonable costs of return when issuing a credit. Where a credit is refused the goods remain the responsibility of the purchaser. Goods of a type not normally held in stock, and therefore specifically ordered are non-returnable except under any warranty.Under no circumstances will TacTree be liable for:i) Defects or damage resulting from fair wear and tear, neglect, improper use by the Buyer, or failure of the Buyer to comply with the manufacturer's instructions.ii) Goods which have been adjusted, altered, adapted or repaired.iii) The suitability of any Goods for any particular purpose or use whether or not the purpose or conditions were communicated to the seller.

Sale & Returns of Custom/Personalised Items

Custom or personalised items, including but not limited to our laser engraved products, are not covered by our standard returns process. Any item this affects requires our additional terms as stipulated below to be accepted before adding to your basket:

- Allow 2 extra business days for processing
- Engraved items cannot be returned, unless faulty under warranty
- Review your spelling as we are not responsible for mis-entered requests
- Requests for profane or objectionable words or phrases will not be honoured

Intellectual Property

All Content included in our catalogue or on our Web Site (www.tactree.co.uk) unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of TacTree, our affiliates or other relevant third parties. By continuing to use our catalogue or our Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws. Subject to exceptions detailed in the Copyright Designs & Patents Act 1988, you may not reproduce, copy, distribute, store or in any other fashion re-use material from the catalogue or Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by TacTree.Our Web Site may contain links to other sites. Unless expressly stated, these sites are not under the control of TacTree or that of our affiliates. We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.

Liability

Except in respect of death or personal injury caused by the Company's negligence, the Company will not by reason of any representation, implied warranty, condition or other term, or any duty at common law or under express terms of this contract, be liable for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the Company's servants or agents or otherwise) which arise out of or in connection with the supply of the Goods and Services.

Errors and omissions excepted

Every effort is made to keep our catalogue/internet pricing and content description error-free. In the event of an error in pricing TacTree reserve the right to withdraw a product from sale.All catalogue and internet photography and descriptions are intended as a guide to the products appearance and description only and manufacturers instructions should always be consulted before use. All items pictured which are added to the core product are displayed for guidance purposes only unless otherwise specified in the product description.TacTree operates a policy of continual improvement to its product range, items may be replaced with products of an equivalent or superior specification at any time.

Credit Card Security

Using your credit card to make purchases via our website is a secure way to pay for your goods and is as safe as booking through our telephone sales system. All sensitive information, including personal details as well as credit card information, is kept confidential through the use of our secure server software. This means that information can only be exchanged between you and us and that a third party cannot access this data. We use Braintree to process all card payments, an industry leader in secure internet transactions. All transaction information passed to Braintree Payment System is encrypted using 128-bit SSL certificates. You can be completely secure in the knowledge that nothing passed to Braintree can be examined or are able to decrypt transaction information and/or cardholder data by any third parties, within our company or Braintree. Furthermore, as required by the UK Data Protection Acts of 1984 and 1998, we follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access. If you would not like your information held, please inform us and it will be securely disposed of.

Sale of Knives or Bladed Articles

It is an offence for any person under the age of 18 years to purchase most kinds of knives. We shall only supply knives and related equipment to customers over the age of 18 years. The sale of knives and bladed articles are regulated by law and subject to these Terms.

We actively check that all customers buying these items are aged over 18 years using AgeChecked in line with our Privacy Policy. If we have been unable to satisfactorily confirm your age you will then be contacted and asked to send to us proof of your age by email. This may be in the form of a copy of your passport, driving licence or other government-issued ID. We will then release your order and you will not need to provide this information again as it will be held on file in line with our Privacy Policy.

We reserve the right to refuse the sale if we have reasonable cause to believe you are below the age of 18 years, or if we believe that the supply of Goods to you may infringe the law or present an unacceptable potential risk to the safety of others. Our main goal is to promote the safe use of the specialist tools and for this reason, we always take steps to ensure that our knives and tools are promoted in a responsible manner.

Sale of Restricted Items

Select items require authorisation in order to complete the sale. We will contact you, the customer in order to obtain the information we require at the point of order. We reserve the right to refuse the sale if we have reasonable cause to believe your are not eligible to purchase these goods, or if we believe the supply of Goods to you may infringe the law.
